Privacy Policy

Schneiderman Furniture, Inc. (hereinafter known as “Schneiderman”, “us”, or “we”) currently owns and operates the website known as https://www.schneidermans.com (the “Site”).  To better protect your privacy we provide this Privacy Policy explaining our online information practices and the choices you can make about the way your information is collected and used. To make this Privacy Policy easy to find, we make links to it available on our homepage and at every point where personally identifiable information may be requested.

  1. Consent to Terms

Your use of this Site and the services (“Services”) and information provided by it will be considered an affirmative act of agreement to this Privacy Policy as well as the Site’s Terms and Conditions, which can be found here. If you object to any of the terms herein, you should immediately refrain from use of the Site.

  1. What We Collect
    1. We may collect personally identifiable information, such as name, address, email address, phone, fax, date of birth, username and password, billing information, transaction information, and credit card information (“Personal Information”).
    2. When you browse the Site, we log your IP address (the Internet address of your computer) to give us an idea of which parts of our website you visit and how long you spend there, but we do not link your IP address to any personal information unless you have logged in to our website. Like many other commercial websites, the Site may use small text files stored by your internet browser called “cookies” to collect information about how you use the site (“Usage Information”).
    3. When you register an account through the Site, we will collect and store the information that you provide to us directly to verify your identity during online registration and subsequent logins.  This may include, among other things:
      1. Your first and last name
      2. Your email address
      3. Your billing/shipping addresses
    4. If you contact Schneiderman to provide feedback about our Site or Services, we may store such communications, including personal information included in the communications, so we can respond to you effectively. 

    5. If you provide reviews, survey responses, or testimonials (collectively, “Testimonials”) for Schneiderman or our products, we may store such Testimonials for current or future promotional use.
    6. Schneiderman limits the collection of Personal Information to what is adequate, relevant, and reasonably necessary in relation to the purposes for which the data are processed, as set forth in this Privacy Policy.

  2. How We Use Information
    1. The Personal Information that Schneiderman collects is used to improve our Services and enhance user experience with the Site and to help us communicate effectively with you.

    2. The Personal Information that Schneiderman collects will be used to identify you, to allow you to login, to manage your account, and to process payments through the Site. 

    3. The Usage Information that Schneiderman collects is used to customize your experience on the Site and improve the quality of our Services.

    4. Testimonials provided by users of the Site (“Users”) may be displayed on the Site or used without restriction in Schneiderman’s marketing efforts. 
  3. How We Share Information
    1. We never sell or rent your Personal Information. We may, however, share information with other Users and some third parties as follows:
      1. We may disclose Personal Information or Usage Information (collectively, “User Information”) collected to any other third party with your prior consent to do so.
      2. We may disclose any of the User Information collected to any of our affiliates or subsidiaries for the purposes of providing you with Services, operating the Site, and other commercial purposes.

      3. Schneiderman may transfer information about Users if Schneiderman is acquired by or merged with another company.  Schneiderman is not responsible for notifying User of such changes.

      4. We may disclose User Information collected about Users if required to do so by law (including, but not limited to, court orders, subpoenas, or warrants), or if in our sole discretion we believe that such disclosure is reasonably necessary to comply with the law. We may also disclose the User Information as necessary to protect or defend Schneiderman rights or property.

      5. We do not limit our disclosure of Usage Information, such as information passively collected from your computer.  If you do not wish for us to collect this information, you should take steps to limit the passive collection of such data through your browser or internet provider.

      6. We reserve the right to disclose Usage Information and Personal Information to vendors who perform services on behalf of Schneiderman, including but not limited to shipping vendors, credit card processors, and website maintenance vendors.  By using the Site or Services, you agree to such disclosure.
  4. Your Rights
    1. Pursuant to the Minnesota Consumer Data Privacy Act (“MCDPA”), you have certain enumerated rights which cannot be waived, as follows:
      1. To confirm whether Schneiderman is processing Personal Information about you and to access the categories of Personal Information being processed.

      2. To correct inaccurate Personal Information regarding you (see Section 10, below).

      3. To delete Personal Information regarding you.

      4. To obtain Personal Information concerning you, which you previously provided to Schneiderman, in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data.

      5. To opt out of the processing of Personal Information for purposes of targeted advertising, the sale of Personal Information, or profiling in furtherance of automated decisions that produce legal effects concerning you (as further detailed in Section 8 below).

      6. If your Personal Information is profiled in furtherance of decisions that produce legal effects concerning you or similarly significant effects concerning you, you have the right to question the result of the profiling, to be informed of the reason that the profiling resulted in the decision, and, if feasible, to be informed of what actions you might have taken to secure a different decision and the actions that you might take to secure a different decision in the future. You have the right to review your Personal Information used in the profiling. If the decision is determined to have been based upon inaccurate Personal Information, taking into account the nature of the Personal Information and the purposes of the processing of the Personal Information, you have the right to have the data corrected and the profiling decision reevaluated based upon the corrected data.

      7. You have the right to obtain a list of the specific third parties to which Schneiderman has disclosed your Personal Information.

  5. Exercising Your Rights

    1. You may exercise the rights set forth in this Privacy Policy by submitting a request, at any time, to Schneiderman specifying which rights you wish to exercise, at 763.551.3544, privacy@schneidermans.com, or 1600 Annapolis Lane N. Plymouth, MN 55441. You can visit the following link to make a request regarding accessing or deleting your Personal Information: Schneiderman’s Furniture Customer Rights Portal. A parent, guardian, or conservator may exercise these rights as well in certain circumstances. 

    2. Schneiderman will comply with a request to exercise a right under this Privacy Policy, as soon as feasibly possible, but no later than 45 days of receipt of the request. Within that 45-day period, Schneiderman will either: (a) inform you of any action taken on such a request, or (b) if Schneiderman does not take action on your request, it will inform you of the reasons for not taking action and instructions for how to appeal the decision (as explained below).

    3. Schneiderman will provide the information set forth in Section 5 free of charge up to twice annually to you. Where requests from you are manifestly unfounded or excessive, Schneiderman may either charge a reasonable fee to cover the administrative costs of complying with the request or refuse to act on the request.

    4. Schneiderman is not required to comply with a request to exercise some of these rights if it is unable to authenticate the request using commercially reasonable efforts. In such cases, Schneiderman may request the provision of additional information reasonably necessary to authenticate the request. 

    5. Schneiderman will not disclose the following Personal Information, but will inform you with sufficient particularity that it has collected that type of Personal Information:
      1. Social Security Number;
      2. Drivers license number or other government identification number; 

      3. Financial account number; 

      4. Account password, security questions, or answers; or

      5. Biometric data.

    6. If Schneiderman obtains Personal Information from a source other than you, when requested to delete it, Schneiderman shall retain the deletion request and the minimum information necessary to ensure your data remains deleted and is not used for purposes outside the MCDPA or opt you out of processing Personal Information for any purpose except those exempted under the MCDPA. 

  6. Appeal Process
    1. You may appeal a refusal by Schneiderman to take action on a request to exercise any of your rights in this Privacy Policy.  To exercise your right to appeal, please put your appeal in writing and mail it to: 1600 Annapolis Lane N. Plymouth, MN 55441 or email it to: privacy@schneidermans.com.

    2. Within 45 days of receipt of an appeal, Schneiderman will inform you of any action taken or not taken in response to the appeal, along with a written explanation of the reasons in support thereof.

  7. Opt-Out; Email Communication
    1. By using the Site, you are consenting to receive certain email communications such as special offers, advice, notifications, surveys, and administrative notices.

    2. You have the option to opt out of receiving certain emails from Schneiderman (or from having Schneiderman process your Personal Information for the purposes of any other targeted advertising). These emails include emails for marketing purposes.  You may not opt out of emails you may receive from Schneiderman regarding administrative purposes. You may remove your email address from our email mailing list (and otherwise “opt out”) by clicking on the “unsubscribe” link at the bottom of any of our promotional emails, or by contacting customer care at 763.551.3544, privacy@schneidermans.com, or 1600 Annapolis Lane N.     3. You may also opt out of any processing of your Personal Information for the purposes of targeted advertising, or any sale of your Personal Information through an opt-out preference signal sent, with your consent, by a platform, technology, or mechanism indicating your intent to opt out of the processing or sale.

    4. You may designate another person as your authorized agent to exercise your opt out rights set forth above. Schneiderman will comply with an opt-out request received from an authorized agent if Schneiderman is able to verify the identity of you and the authorized agent’s authority to act on your behalf.

    5. Schneiderman may deny an opt-out request if Schneiderman has a good faith, reasonable, and documented belief that the request is fraudulent. If Schneiderman denies an opt-out request for this reason, Schneiderman will notify the person who made the request that the request was denied due to Schneiderman’s belief that the request was fraudulent and Schneiderman’s basis for that belief.

  8. External Links
    1. The Site may contain links to other websites. Schneiderman is not responsible for the privacy policies or the content of other websites. If you have any questions about linked websites, you should contact the owner of that website directly.

  9. Changing Personal Information
    1. If the Personal Information you have provided to Schneiderman changes, you may update this information by logging into your account and accessing account settings.  You should change this information as soon as reasonably possible.

  10. Retention of Personal Information
    1. If you choose to close your account, we have no obligation to retain your information and may remove all of your account information. We may retain your information if we believe it will be necessary for legitimate business purposes.

    2. Personal Information or Usage Information is retained for as long as is reasonably necessary to fulfill the purposes described in this Privacy Policy or as required by law, at which time it is deleted from Schneiderman’s database. Subject to your rights set forth in this Privacy Policy: (A) information related to a sales order is retained indefinitely so Schneiderman’s can address any future issues, and (B) Testimonials are retained indefinitely for future and current promotional use. 

  11. How We Protect Information
    1. Schneiderman takes the security of your Personal Information seriously and takes precautions to protect such information.  We implement industry-recognized safeguards to help protect your Personal information. 

    2. User accounts are protected by a password created by you.  It is your responsibility to keep your password safe. If you feel that your password may have been compromised, you should change the password as soon as reasonably possible and notify Schneiderman as soon as reasonably possible.

    3. Because no method of data protection is 100% secure, this is not a guarantee that such information will not be accessed or disclosed by breach of our safeguards.  You understand and agree to assume these risks.

  12. Children Under the Age of 16
    1. The Site is not intended for children under 16 years of age. No one under age 16 may provide any Personal Information to or on the Site. Schneiderman does not knowingly collect Personal Information from children under 16. If you are under 16, do not use or provide any information on the Site. If Schneiderman learns it collected or received Personal Information from a child under 16 without verification of parental consent, Schneiderman will delete that Personal Information.   13. Changes to Our Privacy Policy
    1. Schneiderman reserves the right to change this Privacy Policy at any time.  Changes become effective when they are posted to the Site.  Your continued use of the Site or the Service after such posting will constitute acceptance by you. However, if Schneiderman makes a material change to this Privacy Policy or related practices, it will notify consumers affected by the material change with respect to any prospectively collected Personal Information and provide a reasonable opportunity for consumers to withdraw consent to any further materially different collection, processing, or transfer of previously collected Personal Information under the changed policy.

  14. Nondiscrimination
    1. Schneiderman will not process Personal Information on the basis of your actual or perceived race, color, ethnicity, religion, national origin, sex, gender, gender identity, sexual orientation, familial status, lawful source of income, or disability in a manner that unlawfully discriminates against you. Schneiderman will not discriminate or retaliate against you for exercising any of the rights contained in the MCDPA.

  15. Definitions
    1. Except as indicated herein, all capitalized terms used in this Privacy Policy shall have the meanings ascribed to them in our Terms and Conditions, which can be found here.
